1. This auction site is hosted by Truition [Ltd/plc] ("Truition") of [] on behalf of Comet Group plc ("we" or "us") of []. Your participation in an auction and use of this auction site are subject to the following terms and conditions. Any agreement reached to purchase a product is an agreement with us, not Truition. If you do not accept these terms and conditions you should not take part in any auction. Only persons who are 18 years old or over may participate in an auction. In order to participate in an action you will first be required to provide a valid credit card number. We reserve the right to exclude you, or withdraw your participation, from an auction at any time.
2. Unless stated otherwise, products, which are for auction on this site belong to us and are damaged or discontinued lines. Your attention is drawn to the description given of the product and any defects in the products, which are specifically stated on this site. While we warrant that the products to be auctioned through this site will correspond to the description given, and will except as expressly stated on this site, be of satisfactory quality, we exclude all other warranties, express or implied, in respect of the products.
3. Auctions may be subject to a reserve price and neither we nor Truition will take part in any way although our employees may participate on their own account. Once an auction has commenced the placement of a bid by you constitutes a legal offer to purchase the product under auction, an offer may be accepted at any time.
4. The winning bid in any auction will be the offer accepted and which where applicable, meets any other conditions stated as applicable to a particular auction. The price of the winning bid is inclusive of any value added tax. The price of the winning bid will be taken from your credit/debit card, along with any additional costs applicable.
5. Bids may be refused or removed, including those in respect of which there is dispute or which fail to reach the reserve price (where applicable).
6. Products won on the auction site will be delivered to addresses on the UK mainland only. Goods can only be delivered to the cardholders' addresses.
7. Auctions may be closed early or extended at any time. Auctions may be cancelled or listings withdrawn because of, amongst other things, technical difficulties.
8. On delivery, if the goods are faulty or do not conform to description, you may contact us within 28 days. In such event we will provide a full refund of the sum paid by you as a winning bid and any delivery charges. The nature of the products for auction prevents replacement products being provided in the event faults or failure to conform with description. We will arrange collection at our own expense. Products bought at auction may not otherwise be returned.
9. Neither we nor Truition make any warranty that the web site is free from infection by viruses or anything else that has contaminating or destructive properties. All trademarks, logos or names appearing on this site in connection with an auction are property of their respective owners, as indicated. You may download and print extracts from this site in relation to an auction for your personal use only. No rights, title or interest in any downloaded materials or software is transferred to you by such downloading. No other use may be made of such material without our written permission.
10. Neither we nor Truition accept any liability for any losses or claims arising from any inability to access the web site, any interruption in the conduct of any auction or any failure to complete a transaction. Further, neither we nor Truition accept liability for any loss of profits, administrative inconvenience, anticipated savings, disappointment or wasted expenditure arising out of your participation in an auction. Nothing in these terms and conditions shall limit or exclude our liability for death or personal injury caused by our negligence.
11. While all reasonable care is taken to protect the confidentiality of your credit/debit card details, neither we nor Truition can be liable if, through no fault of our own, these details are intercepted by and used by third parties.
12. English law applies to these terms and conditions, which apply to auctions conducted on this site to the exclusion of any other terms and conditions. You are referred to our Privacy Policy in respect of how we will use any data provided by you to us. Nothing in these terms and conditions affects your statutory rights.
